• Taxes: You are responsible for all applicable taxes

5.3 Refunds and Cancellations

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods

• Train and improve our AI models using anonymized data

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 No Guarantee of Results

We do not warrant or guarantee:

• The accuracy, completeness, or reliability of any analysis or recommendation
• That the Service will meet your specific requirements
• That the Service will be uninterrupted, secure, or error-free
• Any particular outcome from using our Service

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATENTLENS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless PatentLens LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any actions taken based on the Service's output

12. Dispute Resolution

12.1 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.

• Arbitrator: One mutually agreed arbitrator
• Costs: Each party bears its own costs, except as awarded by the arbitrator

12.2 Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12.3 Exceptions

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Termination

You may terminate your account at any time by:

• Cancelling your subscription through account settings
• Requesting account deletion via email
• Ceasing to use the Service

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay subscription fees
• We discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• We may delete your User Content after a retention period
• All accrued rights and obligations survive termination
• No refunds will be provided for unused subscription periods

16. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and you are not on any U.S. prohibited party list.
